You or your spouse must be either (1) a domiciliary of Florida or (2) be a military service member stationed in Florida. In either scenario you or your spouse must be domiciled or stationed in Florida for at least six months and be a resident of the county for at least 90 days at the time of filing the Petition for Divorce with the county district court. What address is on your driver's license? What address is on your federal tax return? If Florida, then you are domiciled in Florida. Military service members do not have to be domiciled in Florida but simply stationed in Florida. If you or your spouse is a Florida resident and either of you is in the military or on government service you are considered a domiciliary of Florida if Florida is your home state.
