Divorce by Publication in Florida

Missing Spouse Divorce – 100% Online, Court-Approved Legal Solution

You Can’t Find Your Spouse – But You Still Deserve Closure

Whether your spouse moved away without notice or has simply cut off all communication, being stuck in legal limbo shouldn’t be your only option. If you've tried everything to locate them, Florida law gives you a path forward: Divorce by Publication.

Our service walks you through the entire process – from search to final judgment – all without court appearances, and handled completely online from home.

What Is Divorce by Publication?

Divorce by Publication is a legal method to get divorced in Florida when your spouse’s location is unknown. Instead of serving them in person, the court allows you to publish a legal notice in a newspaper – but only if you meet specific requirements:

  • Show that you’ve done everything reasonably possible to locate your spouse
  • Submit a court-approved Affidavit of Diligent Search if your spouse is not found
  • Get permission from the court to publish the divorce notice

Once these steps are completed, the court can grant a Final Judgment of Divorce, even without your spouse’s involvement.

We’ve built a proven system to help you navigate this exact situation – 100% online and fully compliant with Florida law.

Your Divorce by Publication Journey

We divide your case into 5 structured phases. At every step, you'll get detailed instructions, clear email notifications, and expert guidance.

Phase 1: Public Records Search

Fee: $175 | Timeframe: 1–2 business days

Your case begins with a welcome email and secure access to your Divorce Portal. Once you sign your Attorney Agreement, we launch a full public records search through databases including credit bureaus, DMV, voter registration, utilities, social media, and incarceration records.

You’ll receive an email titled “Investigator has delivered the report” once results are in.

Phase 2: Diligence Verification – Proving You Tried

Fee: $195 (Client-Guided) or $295 (Full-Service) | Timeframe: 3–7 business days

Once your Search Report is ready, we help you legally document your search through one of two options:

Full-Service ($295): We handle all follow-up efforts: phone calls, emails, certified mail, contact with family or past employers, and jail/death record checks. We compile everything into a court-ready Findings Log and prepare your Affidavit of Diligent Search in case your spouse cannot be located.

Client-Guided ($195): We provide a Search Report and checklist. You follow the steps (calls, letters, emails), log your efforts, and submit your log. Once reviewed, we prepare and notarize your Affidavit of Diligent Search is still declared as missing.

All of this can be done from home – no office visits or in-person appointments required.

Based on the outcome, you’ll receive one of three emails:

  • Spouse located - Next steps in your Divorce Process: We transition your case into a standard uncontested divorce process.
  • Spouse Located - Case Cannot Proceed: Because the case becomes contested, our involvement ends, and we’ll refer you to private legal counsel for litigation.
  • Spouse Not Located - Next Steps: We’ll begin preparing your Affidavit of Diligent Search for court submission.

Phase 3: Court Documents Prepared & Filed

Fee: $195 + $422.28 court fee | Timeframe: 2–4 business days

After your affidavit is notarized, you’ll receive a payment request email titled “Affidavit Notarized – Next Step: Case Processing Fee” This $195 fee covers the preparation of all legal filings.

You’ll then complete an Interview Questionnaire via your portal. Based on your responses, we prepare your Petition for Dissolution of Marriage and Motion for Alternative Service by Publication.

When ready, you’ll review and sign all documents via Remote Online Notarization (RON).

After notarization, we’ll send a “Your documents have been successfully notarized” email with a request for a $422.28 Court Filing Fee payment. To ensure secure and timely processing, we collect court fees via Zelle or Money Order – credit cards are not accepted, as court payments are final and cannot be reversed. These methods help avoid delays, disputes, or disruptions to your case. Once paid, we electronically file your case with the Lee County Clerk of Court — selected for its speed and reliability in handling publication divorces.

No court appearances are required at this stage – we handle all filings, motions, and judge submissions for you.

You’ll then receive confirmation emails titled “Documents Filed to Court” and “Court Number Assigned,” so you can track your progress every step of the way.

Phase 4: Publication in Newspaper

Fee: $265 | Timeframe: 28-day publication + 20-day waiting period

  • Submit and monitor the 4-week publication
  • File the Affidavit of Publication with the court

This step is completed entirely online – no court appearances are needed.

After publication, the court requires a 20-day waiting period before finalization can begin.

Phase 5: Final Judgment

Fee: $195 | Timeframe: 7–14 business days

Once the waiting period ends, we:

  • Draft and file your Motion for Default and Motion for Final Judgment
  • Prepare and submit the Final Judgment to the judge

If granted, you’ll receive an email titled “Divorce Finalized – Congratulations” along with instructions on how to download or request your official court documents.
